  • Procter & Gamble: Global Brand Management and Enforcement

    We advise consumer products giant P&G on all varieties of trademark matters. We provide support to in-house counsel on clearance opinions, advertising review, strategic positioning, procurement, and all manners of enforcement, ranging from cease-and-desist letters to litigation and UDRP proceedings against infringing domain names, as well as thwarting websites that sell counterfeit goods.

  • Maker Studios: Strategic Partnership/Production Agreements

    We negotiated and drafted a Strategic Partnership Agreement between Maker Studios and Tribeca Enterprises to create the YouTube channel “Picture Show” featuring an original web series and short films. We also provide clearance, fair use and trademark opinions for their productions.

  • Cincinnati Reds: Trademark/Brand Portfolio

    From the regal, stark-white “C” against a red background to the distinctive handlebar mustache of Mr. Redlegs, the Cincinnati Reds own a number of unique brands, labels and mascots that contribute to their status as one of Major League Baseball’s most popular teams. Marketing and brand recognition play an integral role in the growth and success of any professional sports franchise and the Reds trust Dinsmore to protect an important part of their identity. Dinsmore is adept at searching federal, state and local registries, as well as performing availability and clearance searches, to help the Reds aggressively promote and expand their brands without exposing the Club to unnecessary risk. Conversely, Dinsmore also helps the Reds protect their brand integrity by ensuring that merchandise and broadcasting rights are registered and cleared through the proper channels. Should unauthorized use of the team name or marks be detected, Dinsmore also serves as local enforcement counsel. Protecting the brands of a team that simultaneously competes against and cooperates with other clubs under MLB marketing and licensing ventures is challenging. Through collaboration with MLB officials on league-wide licensing matters, Dinsmore is able to shepherd the Reds through the trademark registration process in a timely and cost-efficient manner.

  • Crown Equipment: Trademark Registration

    When Crown Equipment, a North American-based equipment manufacturer with international operations, wanted to register and protect a color distinctive of its product line, in-house counsel turned to Dinsmore to guide them through the process. Registration of unconventional marks, such as single-color marks, requires the assimilation and creative presentation of a large amount of brand history, sufficient to establish that the color is as integral to the brand-owner’s identity as its corporate name and principal word marks. We registered the client’s color mark in the U.S., then liaised with foreign counsel to accomplish the same for our client in multiple jurisdictions abroad. The registration of a color mark is a rare and valuable accomplishment, which enables the brand owner to protect and strengthen its brand for many years to come.

  • Luxottica: Advertising/Promotional Counsel, Trademark Clearance and Prosecution

    For many years we have served as national promotions and advertising counsel for Luxottica, a global luxury goods provider, in advising and providing Official Rules, legal documentation and guidance on structuring promotions in a variety of manner and media, including, but not limited to running promotions in social media applications such as Facebook, Instagram, Twitter and Vine, and also providing guidance for internal/wholesale focused promotions as well as consumer-facing promotions. We also assist the client’s in house legal team on trademark clearance, prosecution and enforcement matters. As a “value-add” for this client, we have conducted on-site training to marketing teams based in California, New York and Ohio on promotions and advertising campaigns.

  • Clopay: Trademark/Copyright Counsel

    We represent Clopay Building Products Company, Inc. and Clopay Plastics Company throughout the world on trademark and copyright matters. We help protect and enforce Clopay’s worldwide trademark portfolio for both its garage door and plastics businesses. Our role includes assisting with the clearance of all brand names, the enforcement of rights through cease and desist letters and litigation where necessary, worldwide watching services, and registration throughout the world of Clopay trademarks. We work closely with the in-house Clopay legal team, including conducting frequent on-site visits, to determine and implement the most cost-effective strategies for policing, protection and enforcement of its copyrighted works and trademarks.

  • Vantiv: Trademark Clearance/Licensing Agreements

    We assist Vantiv, a publicly-held provider of payment processing solutions, with its hardware, software and telecommunications purchases and license agreements with service and product providers in the payments industry, consultants, and auditors. We manage the company’s global trademark portfolio, and have assisted with the preparation and prosecution of patents for their data security services. When Vantiv went through a global rebranding several years ago we worked directly with the company to conduct global trademark clearance and ultimately securing ownership of the name in the various countries.
